In the United States, gambling is restricted almost everywhere, except in Las Vegas and in Atlantic City, New Jersey. If you do not know this and unwittingly participated in a gambling scheme that turned out to be illegal, you can still be charged with a gambling crime and may be slapped with significant penalties that may result in some serious repercussions.

Licensed charitable gaming activities shall comply with Executive Order 20-48 which prescribes the utilization of the county assessment system in furtherance of the COVID-19 mitigation efforts. Unless otherwise approved by the local health department, all social gathering and event limitations apply to charitable gaming events. The IGC’s Health and Safety Guidelines (last updated October 13, 2020) shall continue to provide guidance for charitable gaming operations for counties in all assessed Zones.

Local governments may impose more restrictive guidelines. Charitable organizations are not precluded from implementing procedures and policies in addition to, or more stringent, than those listed in the IGC’s Guidelines. Charites should engage in ongoing dialogue and partnership with local health departments. Execution of Health and Safety Plans are the responsibility of each charitable organization and charities must have adequate resources to ensure effectiveness. Staff with complaints will be directed to Indiana Occupational Safety and Health Administration (IOSHA). Patrons concerned with a business' compliance with local COVID mandates should direct those to the local health department.

The Charity Gaming Division will soon begin the formal rulemaking process of re-writing our regulations due to the new statute (IC 4-32.3) and other legislative changes contained within HEA 1517 and SEA 393. The Gaming Control Division is the law enforcement arm of the Indiana Gaming Commission. The Gaming Control Division was established during the 2007 legislative session and became operational on September 10, 2007. The primary job of the Division is to investigate illegal gambling. However, the Gaming Control Officers have full police powers and can enforce all Indiana laws.
The Division has 16 officers. The officers are certified by the Indiana Law Enforcement Academy. All of the current officers have at least eight years of law enforcement experience. They have also received specialized training in investigating illegal gambling.
The Division's goal is to obtain voluntary compliance with the gambling laws through education. Enforcement efforts are also used to accomplish the mission of reducing illegal gambling.
The Division prioritizes investigations. The initial focus was on electronic gaming devices, often referred to as 'Cherry Masters', and as of January 1, 2015 a total of 6,000 illegal devices have been removed from operation by seizure and voluntary removal by distributors. Several illegal bookmaking operations and illegal poker establishments have also had enforcement action taken against them.
It is important to note that a business could lose its retail merchant's certificate, alcohol beverage permit, tobacco sales certificate, and/or charity gaming license for a violation of gambling statutes. The Division uses a common sense approach in all facets of dealing with possible violations. As stated earlier, the goal is to have voluntary compliance and not necessarily make arrests.
